These Terms of Service ("Terms") are a legal agreement between you and Blocsmith, operated by Brandy Digital Ltd ("we", "us", "our"). By creating an account or using our services, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy.

1. About the Service

Blocsmith is an AI-powered website builder that enables users to create, edit, and publish websites through conversational AI interaction. We host and serve published sites on our subdomains and, for paid plans, on custom domains.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account or use our services. Our services are not directed at children.

3. Your Content

You retain all intellectual property rights in the content you create, upload, or publish through Blocsmith, including content generated with our AI tools. AI-generated content becomes your property once created, and you assume full responsibility for it.

By using our services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce, distribute, cache, and transmit your content solely for the purpose of providing, operating, and improving our services. This licence terminates when you delete your content or close your account.

4. AI-Powered Features

Our AI features generate content based on your instructions. AI output may be inaccurate, incomplete, or unsuitable. You must review and verify all AI-generated content before publishing. We do not guarantee that AI-generated content will be accurate, original, legally compliant, or fit for any particular purpose.

We use automated systems to screen content for compliance with our policies. By using our services, you consent to this automated content screening.

5. Acceptable Use

You may not use Blocsmith to create, upload, publish, or transmit content that:

  • Depicts, promotes, or facilitates the sexual exploitation or abuse of children (CSAM) — this results in immediate account termination and reporting to the National Crime Agency
  • Promotes, supports, or glorifies terrorism or violent extremism
  • Shares intimate or sexual images without the subject's consent
  • Contains hate speech or promotes discrimination against protected groups
  • Contains credible threats of violence, or promotes self-harm
  • Facilitates fraud, phishing, scams, or impersonation
  • Infringes any copyright, trademark, or other intellectual property right
  • Contains malware, spyware, or other malicious code
  • Is pornographic or sexually explicit
  • Promotes illegal goods, services, or activities
  • Is created primarily for SEO manipulation or spam

We reserve the right to remove content and terminate accounts at our sole discretion for violations of these policies.

6. Payment and Subscriptions

Paid plans are billed in advance on a recurring basis. Your subscription will automatically renew unless you cancel before the renewal date. If you are a consumer in the UK or EU, you have a 14-day right of cancellation from the date of purchase. Outside of the statutory cooling-off period, payments are non-refundable except where required by law.

When you cancel, your site remains published until the end of your billing period. After that, a grace period applies during which your data is retained but your site is unpublished.

7. Your Published Sites

You are responsible for your published sites and all interactions with your site visitors, including providing your own privacy policy and cookie consent, complying with GDPR and other data protection laws, and handling any complaints or legal claims from visitors.

8. Intellectual Property

All rights in the Blocsmith platform, including software, design, trademarks, and documentation, belong to us or our licensors.

9. Disclaimer of Warranties

To the maximum extent permitted by law, our services are provided "as is" and "as available" without warranties of any kind. We do not warrant that our services will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate or suitable.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law.

If you are a UK consumer, you have legal rights under the Consumer Rights Act 2015 that these Terms cannot override.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages. Our total aggregate liability shall not exceed the greater of the fees paid by you in the 12 months preceding the claim, or £50.

11. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that EU consumers may also bring proceedings in their country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.
